Judge Upholds Gov. Charlie Baker's Vape Ban

BOSTON (WBZ NewsRadio) — A Suffolk Superior Court judge decided Monday to uphold Gov. Charlie Baker's four-month ban on the sale of vaping products.

Judge Douglas Wilkins said that overturning the ban would "contravene the public interest."

However, Judge Douglas Wilkins acknowledged that there were flaws in the way the ban was implemented, and that the Baker Administration must take steps to "cure the defects."

Officials were given until Oct. 28 to alter the guidelines on the sale of nicotine vaping products, and if those necessary changes are not made he will stop the state from enforcing the ban.

This ruling does not apply to any vaping products containing THC, only nicotine vaping products.

Vape shop owners have been fighting the ban, saying that it has been destroying their industry.
